A man has settled his High Court action over injuries suffered after he dived into the shallow end of a swimming pool at night during a Spanish holiday.

Dubliner Robert O'Byrne (25) had sued Michael Stein Travel Ltd in relation to the accident, which occurred while he was on a package holiday with his parents in July 2005.

Mr O'Byrne was 17 at the time and suffered serious injuries after diving into the pool at night.

In June 2008, having reached 18, he initiated his personal injuries action alleging negligence, breach of duty and breach of contract.

When the case was called before Mr Justice Seán Ryan yesterday, he was told the matter had been settled "on specific terms" .
