Terms and Conditions of access to RSS feeds

1. This RSS Feed from the website at www.irishtimes.com is provided by The Irish Times Limited (the "Content Provider").  The RSS Feed will be referred to in these Terms and Conditions as "the Content".  Any person accessing the RSS Feed will be referred to in these Terms and Conditions as "the Licensee" and such access is subject to these Terms and Conditions. 

2. Intellectual Property / Personal Use Only

  • 2.1 The Content Provider (or its licensors) will retain all copyright, database right and all other right, title and interest in and to the Content worldwide.  Subject to the terms of this agreement, the Content Provider hereby grants to the Licensee a non-exclusive licence for the Term to load the Content onto his or her server and view the Content on that server, strictly provided that this Licence relates only to personal use, and access to, the Content.  The Licensee has no right whatsoever to make any commercial use of the Content or to make the Content available for public display. 
  • 2.2 If the Licensee wishes to make commercial use of the Content or to make the Content available for public display, the prior written consent of The Irish Times must be obtained.  The Irish Times shall be entitled, at its sole discretion, to refuse to give that consent or alternatively to make the giving of such written consent applicable to such terms and conditions as it deems appropriate. 
  • 2.3 The Licensee shall not:
    • 2.3.1 edit, modify, use, copy transmit, display or redistribute any Content in any way;
    • 2.3.2 modify any Content, in whole or part, or remove any copyright or trade mark notice from any copies of the Content made under this agreement;

3. Warranties and Exclusions

  • 3.1 The Content Provider warrants that:
    • 3.1.1 it will use reasonable skill and care in provision of the Content under this agreement;
    • 3.1.2 it is entitled to enter the agreement and grant the Licensee the licence to use the Content;
    • 3.1.3 the Content does not infringe any third party's copyright or other intellectual property rights;
    • 3.1.4 none of the Content will be offensive or abusive, or of an obscene or pornographic nature; and
    • 3.1.5 none of the Content breaches any applicable laws, regulations or codes of practice in Ireland.
  • 3.2 As a result of the number of sources from which the Content Provider obtains Content and the nature of electronic distribution via the Internet all warranties, conditions or other terms implied by statute, common law or otherwise are excluded to the fullest extent permitted by law.  In particular, although the Content Provider will make commercially reasonable efforts to maintain the currency, accuracy and availability of the Content, the Content Provider makes no representation that its services under this agreement will be accurate, uninterrupted or error free.  Accordingly the Content Provider will not be liable (and hereby excludes liability) for the consequences of any inaccuracy, interruptions or errors in the Content.
  • 3.3 The Content is intended for general information and use of the Licensee and is not provided for any specific purpose or persons.  Accordingly, it is not intended to be relied upon in making any particular decisions and appropriate independent advice should be obtained before doing so.

4. Limitation of Liability

  • 4.1 The Content Provider will not be liable for loss of revenue, profits or data or for indirect, special or consequential damages arising in connection with this agreement or the Content, event if the Content Provider has been advised of the possibility of such damages.

5. Choice of Law and Jurisdiction

  • 5.1 This agreement shall be subject to the law of Ireland and subject to the jurisdiction of the Irish Courts.
