James Elliott Construction Ltd must provide details of tests in pyrite-related action

James Elliott Construction Ltd must provide precise details of all tests it alleges should have been carried out at a quarry in an action over the supply of allegedly defective infill containing excessive pyrite, a High Court judge has said.

Ms Justice Caroline Costello said James Elliott Construction (JEC) must also give other details, including tests that allegedly were conducted and allegedly failed. The particulars must be provided after such discovery of documents as may be agreed, or ordered, had been made, she directed.

The judge was giving judgment on an application in which Irish Asphalt, Lagan Holdings and three Lagan directors claimed adequate particulars of claims of deceit had not been provided.
