Dunnes Stores in dispute over car park works at Square in Tallaght

High Court action alleges Dunnes has refused to recognise notice of redevelopment

A dispute arising from the proposed €30 million redevelopment of the Square in Tallaght has come before the Commercial Court.

The action against Dunnes Stores Dublin Company has been brought by Square Management Ltd (SML), which manages and owns the freehold of retail units at the centre; National Asset Property Management Ltd (NAPML), which owns the car park lands; and Indego, which has permission for redevelopment and construction of new buildings at the centre.

It is alleged that Dunnes, which has operated at the centre under a lease since the 1990s, refused earlier this year to recognise a notice from SML that common areas including car parking spaces would be redeveloped. It is claimed Dunnes had said the notice had no legal effect or standing, it was not obliged to comply with any timelines in respect of the proposed redevelopment and it did not agree with SML’s proposals.

Mr Justice Brian McGovern agreed to have the case fast-tracked and adjourned it to early next year.
