Bank seeking summary judgment over alleged €1.35 million in loans

AIB Mortgage Bank is seeking summary judgment against a couple over alleged failure to repay some €1.35 million loans for investment properties.

The bank is demanding immediate repayment of loans advanced to Vincent and Kate Farry, Swordlestown, Naas, Co Kildare, between 2003 and 2008. It called in the loans last February but says they have not been paid.

Mr Justice Peter Kelly agreed to transfer the case to the Commercial Court list yesterday. Counsel for the Farrys said they were not objecting to the case being transferred but he wanted time to take instructions from his clients.

Mr Justice Kelly adjourned the matter to later this week when the defendants are to indicate if they are offering a defence to the claim for summary judgment.
