Tadhg and Helena Fox, Mountain Stage, Glenbeigh, Co Kerry, had failed to respond to the bank’s claim within the prescribed time limits and, in those circumstances, Mr Justice Peter Kelly yesterday granted an application by Bernard Dunleavy SC, for ACC, for summary judgment against them.

ACC had last month secured judgment for €4.2 million against Dermot Fahy, St Clernan’s, Craughwell, Loughrea, Galway, arising from loans advanced to him and to the Foxes between September 2003 and May 2007 to buy sites for industrial, commercial and residential use.

Proceedings against the Foxes had been adjourned due to difficulties in personally serving notice of the action on them. The judge had directed service could be made by ordinary post. Mr Dunleavy said the bank had received no communication from them in response to that service.
